Terms of Service

1. Acceptance of Terms

By accessing or using ROE Engine ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and ROE Engine.

2. Description of Service

ROE Engine is a portfolio analytics platform for real estate investors. The Service provides return on equity tracking, refinance analysis, decision recommendations, scenario modeling, and related tools. The Service integrates publicly available mortgage rate data from the Federal Reserve (FRED API).

3. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

You must be at least 18 years old to create an account.

4. Subscription & Payments

ROE Engine offers subscription plans billed annually. Key details:

  • Free Trial: New accounts receive a 14-day free trial with full access to your chosen plan. No credit card is required to start.
  • Billing: Subscriptions are billed annually via Stripe. You authorize recurring charges on your chosen payment method.
  • Plan Changes: You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the end of your current billing period.
  • Cancellation: You may cancel your subscription at any time. Access continues until the end of your current billing period. Your data is preserved but inaccessible after your plan expires.
  • Refunds: We offer a 30-day money-back guarantee on your first annual subscription. After 30 days, no refunds are issued for partial billing periods.

5. Property Limits

Each subscription tier includes a maximum number of active properties. Archived and sold properties do not count toward your limit. If you exceed your plan's property limit, you will not be able to add new active properties until you upgrade your plan or archive existing properties.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Share your account credentials with others or allow multiple users to access a single account
  • Interfere with or disrupt the integrity or performance of the Service

7. Intellectual Property

The Service, including its design, code, algorithms, and content (excluding user-submitted data), is the intellectual property of ROE Engine. You retain full ownership of any data you enter into the Service. You grant us a limited license to process your data solely for the purpose of providing the Service to you.

8. Disclaimer of Financial Advice

ROE Engine is an analytics and decision-support tool. It does not constitute financial, investment, tax, or legal advice. All recommendations, projections, and calculations are based on the data you provide and general market indicators. You should consult with qualified professionals before making any investment, refinancing, or property disposition decisions.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not guarantee the accuracy, completeness, or timeliness of mortgage rates, market data, or any calculations.
  • We are not liable for any investment decisions made based on data or recommendations provided by the Service.
  • Our total liability for any claims arising from the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned maintenance in advance.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time by contacting support. Upon termination, your right to access the Service ceases immediately. You may request data export before termination.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or an in-app notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance. If you disagree with the revised Terms, you may cancel your subscription.

13. Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Davidson County, Tennessee.
